Welcome to PunkRockers.com. It's a free hangout for punk bands, fans, venues and vendors, run by PunkRockers LLC, a Nevada limited liability company ("PunkRockers," "we," "us"). These Terms of Service and Community Rules (the "Terms") apply to the website punkrockers.com, our mobile apps, and anything else we run under the PunkRockers name (together, the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
These rules cover everything on the Service: posts, comments, photos, videos, songs, stories, forum topics and replies, private messages, profiles, band, venue and vendor pages, and show listings. Don't post or send:
Strong language and loud opinions are part of punk, and arguing about bands is fine. Attacking people isn't. We decide what crosses the line, and when in doubt we lean toward keeping the place safe.
We can remove or hide content, limit features, suspend accounts, or permanently ban people, with or without warning, if we think someone broke these Terms, created risk or legal exposure for us or others, or harmed the community. Repeated or serious violations get a permanent ban. Don't make a new account to get around a ban. If you think we got it wrong, email steve@punkrockers.com and we'll take another look.
The Service shows music players, videos and links from other companies, like Spotify, YouTube, SoundCloud and Bandcamp, and ticket links from sellers like Ticketmaster. Those services have their own terms and privacy policies, and their content belongs to them or their artists. We don't control third-party services and aren't responsible for them. Show details (dates, lineups, prices) can change, so always check with the venue or ticket seller.
We respect artists' rights. If you believe something on the Service infringes your copyright, email steve@punkrockers.com with: your contact info; the work you own; the link to the content; a statement that you believe in good faith the use isn't authorized; a statement, under penalty of perjury, that your notice is accurate and you're the owner or authorized to act for the owner; and your physical or electronic signature. We remove infringing content and terminate repeat infringers.
Don't hack, scrape, crawl or overload the Service; don't get around security, blocks or bans; don't harvest other members' info; don't use bots or automated accounts; and don't use the Service to build a competing product or to send unsolicited marketing.
In the app or on the website: log in and go to Settings > Delete Account (on your phone, it's under Menu > Settings & privacy > Account settings > Delete Account), then confirm. It can't be undone.
Can't log in, or prefer email? Email steve@punkrockers.com from the address on your account with the subject "Delete my account" (or "Delete my data"). We'll confirm it's you and delete your account and data, as described in our Privacy Policy, within 30 days.
Deleting your account permanently removes your profile and the content you created. Band, venue or vendor pages you run may stay up if other people also run them, or may go back to "Unverified." Copies already shared by others, cached copies, and backups may take a little while to clear out.
We may update these Terms as the Service grows. If we make big changes, we'll let you know on the Service or by email. If you keep using the Service after changes take effect, you accept the new Terms.
The Service is free and provided "as is" and "as available." To the fullest extent the law allows, PunkRockers disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Service will always be available, secure or error-free. Content on the Service comes from members and third parties, not us, and we don't endorse it. Meeting people from the Service, including at shows, is at your own risk, so be smart and stay safe.
To the fullest extent the law allows, PunkRockers LLC and its members, managers, employees and partners won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from or related to the Service or these Terms. Our total liability for any claim is limited to the greater of $100 or the amount you paid us in the 12 months before the claim (which, since the Service is free, is usually $0). Some places don't allow these limits, so they may not fully apply to you.
If you break these Terms or the law, or post content that causes a claim against us, you agree to cover PunkRockers LLC for the resulting claims, losses and costs, including reasonable attorneys' fees.
These Terms are governed by the laws of the State of Nevada and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute will be handled exclusively in the state or federal courts located in Clark County, Nevada, and you and PunkRockers consent to those courts' jurisdiction. Before filing anything, please email us first. Most problems can be fixed with a conversation.
If you get our app from the Apple App Store or Google Play, these Terms are between you and PunkRockers LLC, not Apple or Google. Apple and Google aren't responsible for the app or its content, have no obligation to provide maintenance or support, and aren't responsible for any claims about the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and can enforce them against you. You also must follow the app store's own terms.
These Terms and our Privacy Policy are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest still applies. If we don't enforce something right away, we haven't waived it. You can't transfer these Terms; we can, for example if PunkRockers is sold or merged.

This Privacy Policy explains what information PunkRockers LLC, a Nevada limited liability company ("PunkRockers," "we," "us"), collects when you use punkrockers.com, our mobile apps and related services (the "Service"), how we use it, and the choices you have. Plain English, no tricks: we don't sell your personal information, and we don't share it for targeted advertising.
We do not sell your personal information or share it for cross-context behavioral advertising. We share it only:
Email is sent through Brevo, and our contact lists are managed in FluentCRM. You'll get account emails we need to send (like password resets). Notification emails can be turned off in your settings. Show and venue promotion emails only go to people who ticked the opt-in box, and every one has an unsubscribe link. Emails you send to steve@punkrockers.com are forwarded to us through ImprovMX.
We keep your info while your account is open. If you delete your account, we delete your profile and the content you created, usually right away. Server backups and logs are overwritten on a rolling basis, typically within about 90 days. We may keep limited info longer if the law requires it, to resolve disputes, or to enforce a ban (for example, a record that an account was banned for abuse).
Depending on where you live (for example, California, Nevada, other U.S. states, the EEA, the UK or Switzerland), you may have rights to access, correct, delete or port your personal information, to object to or restrict certain uses, and to appeal our decision on a request. Email steve@punkrockers.com to make a request. We'll verify it's you and respond within the time the law requires. We won't treat you differently for using your rights. Nevada residents: we don't sell covered information as defined by Nevada law, but you can still send us an opt-out request at the same email.
EEA/UK users: we process your info to provide the Service you signed up for (contract), to keep the Service safe and improve it (legitimate interests), to send optional promotion emails (consent, which you can withdraw any time), and to meet legal obligations. You can also complain to your local data protection authority.
The Service isn't for children under 13 (or under 16 in the EEA, UK and Switzerland). We don't knowingly collect info from children under those ages. If we learn we have, we'll delete the account. Parents can contact us at steve@punkrockers.com.
We use encryption (HTTPS), encrypted passwords, login-attempt limits and other safeguards. No system is 100% secure, so use a strong, unique password and keep it to yourself.
PunkRockers is based in the United States, and your info is stored and processed in the U.S. and wherever our service providers operate. If you use the Service from outside the U.S., your info will be transferred to the U.S., where privacy laws may differ from those where you live.
We don't track you across other websites, so we don't respond differently to Do Not Track signals. If your browser sends a Global Privacy Control signal, we treat it as an opt-out of sale or sharing, and we also skip the small "where did you come from" cookie described above. We don't sell or share your data anyway.
We'll update this policy as the Service changes. If we make big changes, we'll tell you on the Service or by email before they take effect.
